Court Grants Final Approval of $6.3 Million Settlement in Midwestern Pet Foods Product Liability Litigation

On Monday, August 21, 2023, United States District Court Judge Matthew P. Brookman of the U.S. District Court for the Southern District of Indiana, Evansville Division, granted final approval of a class action settlement to resolve claims arising from the sale of pet foods allegedly contaminated with toxic substances.

The settlement creates a $6,375,000 settlement fund from which class members may submit pet injury and/or consumer food purchase claims. Judge Brookman also reaffirmed the appointment of co-lead settlement counsel, including WBE Managing Partner Kenneth A. Wexler who had previously been appointed by the court as interim co-lead counsel.

In re: Midwestern Pet Foods Marketing, Sales Practices, and Product Liability Litigation, Case No.: 3:21-cv-00007 was filed by WBE and co-counsel in early 2021 on behalf of consumers who purchased Sportmix and other Midwestern brand pet food products, allegedly contaminated with a toxic mold known as Aflatoxin, as well as the Salmonella bacteria.
