Case Over Nissan’s Shattering Sunroofs Will Proceed

Wexler Wallace LLP is one of several firms representing Plaintiffs who drive Nissan vehicles with allegedly defective panoramic sunroofs that spontaneously shatter.  On March 17, 2017, Judge Ricardo S. Martinez in the United States District Court for the Western District of Washington largely denied Nissan’s motion to dismiss the case.  Plaintiffs allege violations of Washington’s consumer protection act and breaches of warranties on behalf of all Washington residents who purchased or leased the following Nissan vehicles: model year 2008-2016 Rogue, Maxima, Sentra, Pathfinder or Altima; 2009-2016 Murano; or 2011-2016 Juke.  Judge Martinez’s March 17th order denied Nissan’s motion to dismiss in all respects except claims involving alleged breaches of the implied warranty of merchantability.  Plaintiffs will continue to pursue, among other things, actual damages and injunctive relief.
