WBE and co-counsel filed this case on behalf of Teamsters Local 237 Retiree Fund and all others similarly situated, alleging that Defendant Novo Nordisk Inc. (Novo) engaged in an illegal scheme to delay generic competition for Victoza, a prescription medication designed to improve glycemic control and reduce the risk of major adverse cardiovascular events in patients with type 2 diabetes.

The complaint, filed in the U.S. District Court, Eastern District of New York, alleges that Defendant Novo Nordisk engaged in a scheme to delay competition from cheaper generic versions of its blockbuster drug, Victoza.

Plaintiffs allege that Novo improperly listed patents related to Victoza and entered into an anticompetitive settlement agreement with Teva in 2019 to resolve a number of patent disputes. As part of this arrangement, Teva agreed to end its patent challenge in exchange for Novo’s promise to not launch authorized generic versions of Victoza, instead, giving that right to Teva.

According to Plaintiffs, this allegedly anticompetitive scheme delayed cheaper generic versions of the drug from entering the market as early as 2023. Moreover, the complaint alleges that Novo used this 16-month delay to move market shares from its first-generation GLP-1 product, Victoza, to its second-generation product, Ozempic. Plaintiffs allege that this delay forced consumers to pay more than they otherwise would have.

Plaintiffs are seeking injunctive relief under federal law, as well as recovery of damages under state antitrust and consumer protection laws.
